Terms & Conditions

"Agreement" means these Terms and Conditions together with any service arrangement confirmed in writing between Penaung and the User.

"Services" means the home assistance services offered by Penaung, including Technology Connection Help, Daytime Companionship Programme, and Errand & Appointment Logistics.

"User" or "you" means any individual or family representative who contacts Penaung, uses the website, or enters into a service arrangement.

"Relative" means the older person at home on whose behalf a service arrangement is made.

"Website" means the Penaung website accessible at https://penaunga.blog.

"Content" means all text, images, and other material published on the Website.

By submitting the contact form on the Website, telephoning us, or entering into a service arrangement with Penaung, you confirm that:

• You are at least 18 years of age and have the legal capacity to enter into this Agreement
• You have read and understood these Terms
• Where you are arranging services on behalf of a relative, you have the authority to do so

If you do not agree to these Terms, please do not use the Website or engage our services.

Penaung provides home-based companionship and coordination services for older relatives in Kuala Lumpur, Wilayah Persekutuan. Our services currently include:

• Technology Connection Help — device setup and practice sessions to support video calls, messaging, and photo sharing
• Daytime Companionship Programme — structured daytime companionship at home on agreed days
• Errand & Appointment Logistics — coordination of grocery runs, parcel collection, and transport for outings

Services are available within the Kuala Lumpur area. Availability may vary and is subject to confirmation at the time of enquiry. Penaung reserves the right to modify or discontinue any service with reasonable notice.

Our services are organisational and companionship in nature. They do not constitute, and should not be understood as, any form of regulated professional activity.

When using the Website or engaging our services, you agree to:

• Provide accurate and complete information when making an enquiry or arranging services
• Inform us promptly of any changes in the relative's circumstances that may affect service delivery
• Use the Website for lawful purposes only
• Not misrepresent your identity or the nature of your enquiry
• Not interfere with the operation of the Website or attempt to access areas or systems not intended for public use

All content on the Website — including text, images, layout, and design — is owned by or licensed to Penaung. You may not reproduce, distribute, or use any part of the Website's content for commercial purposes without our prior written permission.

You are permitted to view and print pages from the Website for personal, non-commercial reference only.

All prices are quoted in Malaysian Ringgit (RM). Specific pricing for each service is as listed on the Website and confirmed in writing before any arrangement begins.

Payment terms — including timing, method, and any applicable deposit — are agreed between Penaung and the User before the service commences. Accepted payment methods will be confirmed at the time of arrangement.

Cancellations and changes: Where a service arrangement is cancelled or significantly changed by the User after it has been confirmed, reasonable notice must be given. Arrangements for compensation or rescheduling will be discussed on a case-by-case basis, taking into account work already undertaken by Penaung.

Penaung does not offer automatic refunds. Any refund consideration is handled individually and communicated in writing.

Each service arrangement is confirmed in advance and includes the scope, schedule, and any inclusions relevant to that service. Penaung will make reasonable efforts to deliver services as agreed.

Where circumstances outside our control — including but not limited to the relative's health, safety considerations, or access restrictions — prevent a session from proceeding as planned, Penaung will notify the family promptly and work to reschedule at the earliest suitable time.

Changes to a confirmed service scope requested by the User will be discussed and agreed in writing before they take effect. Additional scope may be subject to revised pricing.

Penaung maintains reasonable confidentiality regarding information shared by families in the course of arranging or receiving services. This does not limit our ability to involve appropriate parties where the safety or wellbeing of a relative gives rise to serious concern.

The Website and its content are provided "as is". While we make reasonable efforts to keep information accurate and up to date, we do not warrant that the Website will be error-free or uninterrupted.

Penaung's services are general companionship and coordination services. We do not provide regulated professional services of any kind, and nothing on the Website or in our service arrangements constitutes professional advice.

We do not make assurances about specific outcomes arising from our services. The arrangements we offer are intended to provide practical support; their effect on any individual's circumstances will vary.

To the fullest extent permitted by Malaysian law, Penaung's liability arising from or in connection with any service arrangement or use of the Website shall not exceed the amount paid by the User for the specific service to which the liability relates.

Penaung shall not be liable for indirect, incidental, or consequential losses, including but not limited to loss of time, inconvenience, or loss arising from circumstances outside our reasonable control.

Nothing in these Terms limits liability for death, personal injury caused by negligence, or any other liability that cannot be excluded under Malaysian law.

Either party may end a service arrangement by giving the other reasonable written notice. The appropriate notice period will depend on the nature and duration of the arrangement and will be agreed at the outset.

Penaung may suspend or end a service arrangement without prior notice where a User has materially breached these Terms, where the safety or wellbeing of our personnel is at risk, or where continued service delivery is no longer practicable.

Provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive the termination of any service arrangement.

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or from a service arrangement will first be referred to informal discussion between the parties. We will make a reasonable effort to resolve concerns raised by Users in good faith within 14 working days.

If a dispute cannot be resolved informally, it may be referred to mediation through the Malaysian Mediation Centre before any court proceedings are commenced.

You agree to submit to the exclusive jurisdiction of the courts of Malaysia for any matters that cannot be resolved through the above process.

Entire agreement. These Terms, together with any confirmed service arrangement, constitute the entire agreement between you and Penaung in relation to the subject matter.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver. A failure by either party to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision.

Assignment. You may not transfer your rights or obligations under these Terms to any other person without our written consent. Penaung may assign its rights in connection with a business transfer.

Notices. Formal notices under these Terms should be sent in writing to the contact addresses given in Section 15.

We may update these Terms from time to time. The revised Terms will be published on this page with an updated "Last updated" date. For material changes, we will make reasonable effort to notify existing contacts.

Continued use of the Website or our services after updated Terms are published constitutes acceptance of the revised Terms.
